Foreclosure

Foreclosures can be very stressful for homeowners, so you want an attorney with experience handling these cases. We here at WHITAKER LAW have defended over 456 foreclosure cases.

Florida's latest foreclosure law speeds up the foreclosure process by requiring the homeowner to prove to the Court in an "order to show cause hearing" that the foreclosure should be stopped. The biggest relief to the homeowner is that the Bank will only have one year to pursue a deficiency judgment (i.e. the difference between what the homeowner owes on the loan and what the home sells for at a foreclosure sale).

Depending on the court schedule, it usually takes approximately 180-200 days to effectuate an uncontested foreclosure. This process may be delayed if the borrower contests the action, seeks delays and adjournments of hearings, or files for bankruptcy.
